Guest User Disclaimer
IMPORTANT: READ BEFORE RECORDING
By accessing and using TrainBase's guest recording feature (the "Trial Service"), you acknowledge and agree to the following terms. This disclaimer supplements our Terms of Service and Privacy Policy.
NO REAL PATIENT DATA
YOU MUST NOT RECORD ANY REAL PATIENT INFORMATION. This includes:
- Actual patient names, dates of birth, or identifying information
- Real electronic medical records or patient charts
- Video or audio of actual patients
- Any protected health information (PHI) as defined under HIPAA
Use only simulated data, training scenarios, or dummy information for your trial recording.
Temporary Data Storage
- Your trial recording is stored temporarily for processing purposes only.
- If you do not create a TrainBase account and claim your video within 24 hours, all data will be permanently deleted from our systems.
- No backup copies are retained after deletion.
- You cannot recover deleted trial recordings.
Security Limitations of the Trial Service
IMPORTANT SECURITY DISCLOSURES:
- Encryption at rest. Trial recordings are encrypted at rest using AES-256-GCM during the 24-hour retention period. In-transit encryption (TLS) is also applied. However, encryption keys are managed by TrainBase and not under your control.
- No audit trail. Unlike paid accounts, guest recordings are not subject to access logging or audit controls. TrainBase does not track who accesses or views trial recordings during the retention period.
- No HIPAA protections. The Trial Service is not covered by TrainBase's Business Associate Agreement. No BAA is in effect for guest users. HIPAA safeguards (access controls, audit logs, breach notification) do not apply to trial recordings.
- Subject to legal process. Trial recordings may be subject to subpoena, court order, or other legal process during the retention period. TrainBase may be compelled to produce trial data in response to valid legal requests.
- No guaranteed deletion timeline. While TrainBase targets 24-hour deletion, system failures, backups, or operational delays may cause temporary files to persist beyond the stated retention period.
No Warranty or Support
The Trial Service is provided "as is" without any warranties or guarantees. TrainBase provides no technical support, uptime guarantees, or quality assurances for trial recordings.
Liability Disclaimer
TrainBase disclaims all liability for:
- Any unauthorized disclosure of information you choose to record
- Loss of data due to automatic deletion
- Technical issues affecting recording quality or processing
- Any violations of privacy laws resulting from your recording choices
- Any HIPAA violations resulting from your use of real PHI in the Trial Service
Agreement to Terms
BY CLICKING "START RECORDING" OR USING THE TRIAL SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS DISCLAIMER.
